Le procedure di recepimento del diritto dell’UE assunte come elemento fattuale o vagliate in relazione ad un elemento fattuale nella giurisprudenza costituzionale

The article analyses the case-law of the Italian Constitutional Court concerning the procedures for implementing EU law which are seen by the Court as factual elements or scrutinized in relation to factual elements. It will be argued that this approach is the consequence of the dualist interpretation of the Italian Constitutional Court of the relationship between the EU and Member states
