The electoral threshold established by the national legislator for the election of members of the European Parliament due to Italy was considered by the Constitutional Court, with the decision in comment, functional to “ensure the governability” and “avoid the political-party fragmentation that it could slow down or paralyze decision-making processes within the parliamentary assembly”, even in the light of the undoubted parliamentary transformation of the form of government of the European Union. The rejection of the questions of constitutional legitimacy thus proposed leaves, however, still unprejudiced some “open” questions: the possibility of a preliminary ruling procedure before the EU Court of Justice and a constitutional ruling that beats the “timing” of the electoral reforms.
