The non-inclusion of containers insurance coverage within the notion of “large risk” insurance contracts does not seem, alone take, a sufficient element to exclude their inclusion. Abstract
The non-inclusion of containers insurance coverage within the notion of “large risk” insurance contracts does not seem, alone take, a sufficient element to exclude their inclusion. On the contrary, the opposite solution could be favoured by the Court of Justice of the European Union in light of the founding PIL principles that, although in other contexts, have already been widely analysed. The inclusion of such contracts within the class of “large risk” insurance contracts could also be favoured by the EU lawgiver, even though it does not seem possible to determine as of today what methodologies will be employed to that end if the Institutions decide to take action to solve an interpretative problem that is particularly relevant to the practice of international commerceFile | Dimensione | Formato | |
