The article examines the Regulations which prohibit the import, sale and use of asbestos and the manufacture, import, sale and use of products containing asbestos in Canada, with a limited number of exclusions, just approved in 2017 and 2018 by the Government of Canada. The A. analyses the competences on asbestos of the Federation and Provinces coming from Constitution Act 1867 and gives some explanations of the restrained appeal to Canadian Courts to solve asbestos related claims. Besides she express a critical opinion on the exclusion of mining residues containing asbestos from Federal ban, because it could have a negative impact over the health of workers and inhabitants of neighboring areas
