The preliminary provisions of the 1942 Italian navigation code provide a rather complex system of specialized PIL rules, mainly based on the reference to the law of the flag. Such provisions, however, apply only to cases and issues falling outside the scope of application of the relevant (i) uniform law Conventions, or (ii) EU Regulations of PIL. Italian courts, moreover, frequently prefer the general criteria provided by the Law No. 218/1995 (i.e., the law that more than two decades ago reformed the Italian PIL) especially when no effective connection exists between the flag State and the concrete situation. Taking these factors into account, the present contribution (i) assesses the opportunity of maintaining the system of specialized PIL rules in force and (ii) considers the possibility of their abrogation in toto, with a corresponding “attraction” by the Law no. 218/95 of the few integrations required for the regulation of navigation-related relationships.
