Among the standards approved by the Fourth Lateran Council, the XXI stands out as the most important of the sacramental discipline. As usual, it takes the name from its opening words, Omnis sexus utriusque. Through dialogue, the Church not only sanctioned a universal law that established for the believers the obligation of annual confessions of all their sins to their priest in order to receive at least at Easter, after the execution of the imposed penance, the sacrament of the Eucharist, but it also introduced a broader regulation of the same sacrament which involved a significant issue such as that of sigillum confessionis and the related penalties applicable in case of its violation. For the first time this institution, which has its roots in the divine right, received a general and organic legislation intended to become the subject of reflection on the part of the doctrine, especially in the wake of its reception in the Liber Extra by Gregory IX (X 5. 38. 12). After a brief excursus on the emergence of a first compulsory regulation in relation to the confession secret in the jus vetus, we will try to understand the impact of pope Innocent’s regulations on the doctrinal reflection and the development of later regulations in this field between Middle Ages and the modern age.
Fra i canoni approvati dal Concilio Lateranense IV spicca per importanza nella disciplina sacramentale il XXI intitolato, come di consueto dalle parole iniziali, Omnis utriusque sexus. Con esso la Chiesa non sancì soltanto una normativa universale che stabiliva per il fedele l'obbligo della confessione annuale di tutti i suoi peccati al proprio parroco, al fine di poter ricevere almeno a Pasqua, previa esecuzione della penitenza imposta, il sacramento dell'eucarestia, ma introdusse anche una regolamentazione più ampia dello stesso sacramento che toccava un tema rilevante quale quello del sigillum confessionis e delle relative pene previste in caso di sua violazione. Per la prima volta quest'istituto, che affonda le sue radici nel diritto divino, riceveva una disciplina normativa generale ed organica destinata a divenire oggetto di riflessioni da parte della dottrina, soprattutto a seguito della sua recezione all'interno del Liber Extra di Gregorio IX (X 5. 38. 12). Premesso un breve excursus sull'emersione nello ius vetus di una prima regolamentazione dell'obbligo del segreto in relazione alla confessione, si cercherà di comprendere l'impatto della normativa innocenziana sulla riflessione dottrinale e sullo sviluppo della successiva disciplina in materia fra Medioevo ed età moderna.
