Historical-comparative research on the origins of trusts in England. It shows that the European fideicommissum confidentiale was actually known in England and that the notion of “confidentia” found its way there in cases of the mid-XVth century. It also shows that the actual rules prevailing in Europe on “confidentia” were received in England where that institution, known at the time as “trust and confidence”, was then developed into inter vivos relationships and later into the modern law of trusts.

Abstract

Historical-comparative research on the origins of trusts in England.
