The author examines “reasonable adaptation” of labor law to maritime work, focusing the implications of globalisation and U.E. rules in equal rights on seamen activity in connection with their work peculiarities. The author then proceeds with the critical examination of different requirements in free competition on the one hand and social rights on the other hand; and discusses problems relating to crew nationality and wages, recent decisions of European Justice Court (“Viking” and “Laval” cases) and the new employment law (dpr 2006/231) relating to navigation area.
