This article analyses two judgments of the Italian Supreme Court that faced - by reaching opposing conclusions - the delicate theme of the configurability of complicity in the offence of bribery of the person who intervenes in the executive phase of the agreement, without having taken part in the conclusion of the "pactum sceleris"
