In the decision under exam, Italian supreme Court confirmed the complicity in the robbery of the person who - acting as a "basist" - had offered hospitality and had supported the perpetrators, by providing them with logistical support before and during the commission of the crime. The persistent critical issues arising from an over-hasty assessment of accomplice liability has been highlighted by the questionable motivational line followed by the Court. Proceeding in this way, the risk of undermining respect for essential guarantee principles of Italian criminal law - such as that of the personality of criminal liability - is very high.
