In the analyzed decision, the Italian Supreme Court reasserts some key points in the theme of abandonment child and incapacitated persons and it confirms that this crime can be committed with “eventual intent”. However, the single judge has to do a rigorous assessment, using the parameters indicated by the Supreme Court’s Sezioni unite in the well-known “Thyssenkrupp” verdict.
