By starting with a case-law reconstruction, the work seeks to highlight applicative problems courts have experienced in determining the possibility for companies to lawfully rely on the linguistic exception to service under art. 8 of the Service of Documents Regulation. In an effort to at least partially settle the matter, it further elaborates some elements that – should they be transposed within a recital of the relevant instrument – could offer uniform guidelines to those judges before whom multinational companies invoke the refusal of service based on linguistic grounds.
