Abstract

Paolo Emilio Bensa’s figure is representative of the peculiar dichotomy, which distinguishes Italian juridical culture in general and, very especially, Genoese one, between the 19th and 20th centuries. The typical attention paid to legal practice, mostly influenced by Napoleonic Codes and French methodology, is now associated with the latest influence of German Pandectist doctrine, providing an original approach. This paper presents a new perspective on Bensa’s multi-faceted educational path, which led him from Genoa to Leipzig to follow Bernhard Windscheid’s courses and paved the way for his peculiar scientific and didactic production, culminated in the translation of Windscheid’s Lehrbuch. .
2016
