The essay analyses in a comparative perspective the rules of stipulating a virtual contract in the Italian and French law, moving from an analysis of the respective concerned disciplines (of legislative and jurisprudential matrix) to the formation of the contract: the appealing idea is that the confirmation of the order can represent not just a mere obligation by the supplier of the good or internet service, but also an act that becomes part of the process of the formation of the virtual contract, and, in case of breach of contract, then the relative formative procedure may be considered not concluded. In this essay, the Author will illustrate the reasons that support such a peculiar conclusion, both in the Italian and in French law.
