Abstract

The task of this contribution is to examine the Dobbs v. Jackson Women’s Health Organization ruling handed down by the U.S. Supreme Court in 2021, which, overruling the precedents Roe v. Wade and Planned Parenthood v. Casey, ruled that termination of pregnancy is a matter for the states. Two issues that emerge from the aforementioned judgment are discussed : the first aims to explore whether the ruling is the result of the influence of the Catholic and conservative tradition ; the second focuses on the question of whether the effects of the ruling can find a barrier in modern constitutionalism.
