LA SOSTENIBILITÀ DEL DEBITO PUBBLICO COME RAGIONEVOLE LIMITAZIONE DELLA RESPONSABILITÀ PATRIMONIALE DEGLI ENTI LOCALI DISSESTATI? (Nota a sentenza Corte costituzionale 24 ottobre 2022, n. 219)

The work examines the argumentative path followed by the Constitutional Court in rejecting a question of constitutional legitimacy concerning the rule with which the temporary uncollectability of the accessories connected to the credits accrued against the local authorities accessing the bankruptcy procedure. In particular, the present work analyzes the ratio of the ruling and its connections with the most recent jurisprudence of the Court on the subject of enlarged public finance, underlining the terms and the ultimate objectives of the balance operated by the Judge of laws between the principle of sustainability of the debts of the public administrations and the regime of patrimonial liability to which they are subject, pursuant to art. 2740 cod. civ.
