The paper deals with the professio donationis, a praxis contrasted in a few impe- rial constitutions of the Severian and Diocletian age handed down by the Vaticana Fragmenta, aiming at achieving a donatio perfecta without the traditio of the res donata. Through the analysis of the phenomenon and the comparison with the legal uses of the eastern provinces of the Empire it is highlighted that this praxis represents an example of a misunderstanding application of Roman law in those territories that is not reflected in the West.

Abstract
