In the Randstad case the European judge resolved two of the three preliminary questions raised by the United Sections of the Court of Cassation. The sentence has not entered into the issues, of constitutional significance, relating to the scope of the concept of jurisdiction pursuant to art. 111, co. 8., Constitution —, verifying instead the compliance of the Italian judicial system with the principles of equivalence and effectiveness — as binding limits to the procedural autonomy of the member states — and reaffirming the incompat- ibility with European Union law of the well-known jurisprudence of the Council of State on the so-called paralyzing incidental appeals in the field of public procurement.

Abstract

In the Randstad case the European judge resolved two of the three preliminary questions raised by the United Sections of the Court of Cassation.
