The paper analyzes the various remedies available to the purchaser in case of delivery of an artwork which differs from the contractual arrangements according to the general discipline of the Italian Civil Code and to the Italian jurisprudence. The author, in particular, addresses several aspects of this discipline, such as the burden of proof, the liability imputation’s criteria, the compensable damages and the statute of limitations’ rules, with the aim to point out — from a practical point of view — how the current regulatory framework should be reconsidered in a more appropriate and balanced way
