Following an interesting suggestion provided by Christoph Engel, the paper aims to compare some tenets of Friedrich Müller’s theory of interpretation and judicial reasoning with some of the most relevant of John Dewey’s contributions on the issue. Highlighting some interesting analogies, as well as some notable differences, between the two perspectives, the paper explores some central problems related to the role of the judge in the frame of constitutional democracy.
