The formulation of the questions to be submitted to the court-appointed expert witness (CTU) is an activity that needs proper attention by the Judge in order to allow for advice that is scientifically minded and technically useful for the purposes of judgment. A recent court case has highlighted the problems that still exist in the field of court-appointed expert witnesses and in particular in the formulation of questions to the CTU. The court case, taken into consideration in this article, has been matter for thought and insight into the criteria that each Judge should adopt to formulate the questions in an appropriate manner. A procedural system that allows the Judge to formulate correct, precise and timely questions, with the cooperation of the parties and the entire expert panel, from the very beginning of the proceedings, would be desirable for the successful outcome of the dispute, saving time and resources.
