The paper aims to analyze the definitions of 'sex', 'gender', 'sexual orientation' and 'gender identity' contained in the DDL Zan (art. 1). The analysis is conducted in the light of the complex debate on the relationship between ‘sex’ and ‘gender’, which is a very divisive issue in feminist studies (and not only). Particular attention is paid to the definition of gender identity, which includes the notions of sex and gender, and to the criticisms addressed to this definition, also by some minority but authoritative voices of Italian feminism.

Abstract

The paper aims to analyze the definitions of 'sex', 'gender', 'sexual orientation' and 'gender identity' contained in the DDL Zan (art. 1). The analysis is conducted in the light of the complex debate on the relationship between ‘sex’ and ‘gender’, which is a very divisive issue in feminist studies (and not only). Particular attention is paid to the definition of gender identity, which includes the notions of sex and gender, and to the criticisms addressed to this definition, also by some minority but authoritative voices of Italian feminism.
