In its ruling, the Italian Constitutional Court found Article 69 paragraph 4 of the Italian Criminal Code unconstitutional limited to the section providing for the prohibition of prevalence of the mitigating circumstance of partial mental defectiveness (Article 89 of the Italian Criminal Code) due to incompatibility with the principle of reasonableness (Article 3 of the Italian Constitution) and with the re-educational function of punishment (Article 27 paragraph 3 of the Italian Constitution). This decision currently represents the fast blow inflicted by the Italian Constitutional Court to the automatic recognition of "reiterated recurrence" and it is, therefore, part of the process whereby the latest decisions have gradually broadened the discretionary powers of the judge
