In the Mood For Meaning. Considerazioni sulla teoria pragmaticamente orientata dell'interpretazione giuridica

In this work I endeavor to criticize some of the theses defended by Vittorio Villa in his pragmatically oriented theory of legal interpretation. First of all, I will show that the attack to the so-called “School of Genoa” is misfired. It is not true that the Genovese authors consider the theory of meaning either as a silly enterprise or as sheer ideology. It is false as well that they either have no theory of meaning at all or that they just presuppose some “generalist” theory of meaning. Secondly, I shall demonstrate that every theory of meaning, in order to be satisfactory, should recognize the semantic and inferential role of the illocutionary force. Finally, I shall point out that the justification of Villa’s theory implies at least one ideological argument. In the last section of this work – as a conclusion - I will also briefly discuss some implications of a possible amendment to this theory.

In questo lavoro intendo criticare alcune delle tesi proposte da Vittorio Villa nella sua teoria pragmaticamente orientata dell’interpretazione giuridica. In primo luogo, mostrerò che l’attacco alla cosiddetta “Scuola Genovese” non colpisce nel segno. E’ infondata la considerazione che i Genovesi ritengano la teoria del significato come un’impresa sconsiderata o meramente ideologica. E’ altrettanto infondato sostenere che non hanno per nulla una teoria del significato o, ancora, che ne presuppongono una “generalista”. In secondo luogo, dimostrerò che una teoria del significato, per essere soddisfacente, deve riconoscere il ruolo semantico e inferenziale della forza illocutoria. Infine, evidenzierò che la teoria di Villa ha, fra le sue giustificazioni, (almeno) un argomento ideologico. Nell’ultima sezione del lavoro – come conclusione – discuterò brevemente alcune implicazioni di un possibile emendamento alla teoria in questione.
