The paper briefly recalls the lessons learned from the “Sezioni Unite” of Italian Corte di Cassazione in 2008 and the legal system of biological damages outlined by article 138 of legislative decree no. 209 of 7 September 2005. This paper then analyzes the topic of moral damages from Corte di Cassazione n. 25164/2020, criticizing the idea that moral damages can be separated from the quantification of biological damages, given that moral damages are comprised within the biological damages category, as well as existential damages. From aphenomenological perspective, biological damages,moral damages, and existential damages are the three descriptive categories that make up the conceptual category of non-pecuniary damages.
