Offensività e colpevolezza nel controllo di costituzionalità in materia di recidiva e giudizio di bilanciamento

The decision n. 73/2020 of the Italian Constitutional Court sets out an unprecedented line of reasoning which enhances the subjective ground of culpability, through the principle of proportionality and reasonableness. Starting from the recent constitutional judgment about the circumstance of partial mental insanity (art. 89 c.p.), up to the previous sentences on recidivism and article 69, co. 4, c.p., it is possible to fully understand the sense of this new reasoning based on culpability, particularly in its consequences for the commensuration of criminal sanction
