In this judgment the Supreme Court of Cassation faces the meaning of negligence caused by "violation of road traffic regulation rules" at the abolished art. 589, c. 2, c.p., and at artt. 589-bis and 590-bis c.p. The Court deals with the majority part of the jurisprudence, which on the one hand stated "street negligence" also in cases of generic violations of duty of care (without the violation of a specific written rule) and, on the other hand, asserted the possibility of applying the above mentioned aggravating circumstance also to subjects different than "users" of the road. The judgment leads to quite innovative solutions, especially with reference to possible authors of "street crimes"
