La giustizia internazionale e il reato di reclutamento, coscrizione e impiego attivo di minori in conflitti armati: il caso Lubanga

The Lubanga case represents for several reasons, both factual and temporal, a leading case, in which the judges of the International Criminal Court had to assess for the first time issues of particular concern related to various problems of both substantive and procedural nature strictly connected to the interpretation and application of the rules governing the fuctioning of the Court itself. Far from providing an exhaustive and comprehensive report of the complex procedural history involving Thomas Lubanga Dyilo, the paper seeks to focus on some particularly interesting issues arising from the case at stake, starting from the opening of the investigations to the most recent appeal judgments, with a special focus on the participation of victims in the proceedings and their right to redress.
