The thesis aims to examine the rules guiding the judge in the determination of punishment within the Italian criminal trial. In the first part, are analized the provisions contained in the Italian Criminal Code and, in particular, those that govern the judge’s discretionary power. The thesis, then, goes on to address the procedural aspects of the determination of punishment in terms of object of evidence, issue of confrontation between the parties to the trial and matter on which the judge is required to give adequate reasons within the judgement. After identifying the causes that have prevented sentencing from carving out a sufficient place for itself in the Italian criminal trial, the dissertation ends with an in-depth analysis of the different commisuration models (monophasic and biphasic) especcially in the light of the innovations recently introduced in the penal system by the so-called 'Cartabia reform' (d.lgs. 150/2022).
La tesi si propone di analizzare la disciplina della commisurazione della pena all’interno del processo penale. Nella prima parte, vengono prese in considerazione le disposizioni contenute nella Codice penale e, in particolare, viene approfondito lo studio del potere discrezionale del giudice in materia sanzionatoria. Lo studio prosegue, poi, affrontando i profili processuali della commisurazione della pena e, in particolare, compie un’analisi della pena come oggetto di prova, come argomento del contraddittorio tra le parti e come punto della decisione sulla quale il giudice è tenuto a motivare adeguatamente. Preso atto della sostanziale mancanza di garanzie e di spazio che la determinazione della pena è riuscita a ritagliarsi nel processo penale italiano, la tesi si conclude con uno sguardo ai diversi modelli di commisurazione della pena (monofasico e bifasico) anche alla luce delle novità recentemente introdotte in materia penale dalla c.d. “riforma Cartabia” (d.lgs. 150/2022).
