After having laid out the foundations and provided an overview of the EU’s action in the field of maritime safety and marine environmental protection, this book chapter critically examines the EU’s third maritime safety package of 23 April 2009 in the context of existing policy trends. Two aspects dealt with by this legislative initiative are in particular taken into account: the establishment of places of refuge as a tool for preventing environmental emergencies at sea (with a focus on conditions and decision-making processes according to Directive 2009/17/EC) and the management of environmental emergencies at sea and the obligation (pursuant to Directive 2009/18/EC) to conduct a safety investigation after very serious marine casualties.
