Comparing the Continental Europe with the English mercantile courts system to check if it was an international circulation of models between the Mainland and the Anglo-Saxon world, the impression is that the english merchant justice retains many of the characteristics of common law and that, in this respect ,each system keep, dispite an homogeneous mutual fund, its individual peculiarities. Comparando il procedimento mercantile continentale con quello inglese per verificare se si trattasse di un insieme di usi procedurali potenzialmente internazionale e quindi ipotizzare una circolazione di modelli tra il continente ed il mondo anglosassone, l’impressione è che la giustizia mercantile in Inghilterra conservi molte delle caratteristiche proprie del common law e che quindi, sotto questo aspetto ciascuna realtà mantenga, al di là di un fondo comune irrinunciabile ed omogeneo, le proprie singole peculiarità.
