The contribution provides a commentary, article by article, of the provisions of the EC Treaty dealing with the European transport policy and represents a part of a collective work, under the direction of Prof. Antonio Tizzano, then Advocate General and now Judge at the European Court of Justice, aimed at providing a comprehensive and in-depth scientific presentation of primary and secondary legislation in this field as well as of the important impact of the ECJ's case law. The commentary deals therefore with principles of general nature as well as with more specific provisions and touches upon a variety of issues and questions relating to a wide range of aspects of the European transport policy and law, including - for example - various means of transport (road, rail, air, sea, river), the existing interconnections between the European transport policy and other Europeam policies (competition, environment, freedom to provide services) and the body of European rules applicable to transport infrastructures such as railroad, ports and airports. Specific attention is paid to the role played by the Court of Justice, whose main judgments are analysed in depth with a view to emphasise their role in the evolution of the European transport policy as a whole.
