In the framework of an analysis of the process of reform of the European institutions, which takes into account their original character, this essay examines some relevant aspects of the draft of Constitutional Treaty, which was elaborated by the Convention of Brussels and modified after the negative results of the French and Dutch referendum, during the long process which brings to the Treaty of Lisbon. The research focus on the EU system of sources of law, studying the preparatory works of the Convention, also in the light of the European constitutional traditions and experiences. The heart of the research is the analysis of the choices on the item of the delegated legislation, in order to enlighten the logic of the model chosen in that moment and its potential impact on the institutional dynamic and governance of the Union.
