The aim of this paper is to highlight the resistance and openness of the post-unitary jurisprudence on the subject of “maternal authority”. Despite the attribution of parental authority to both parents, in practice there were many obstacles to the promotion of the mother into the family; these include the presence of the Family Council and the conservative attitude of much of the jurisprudence, which will be taken into account in this essay.

Abstract
