The contribution aims to provide a concise analysis of the possible impact of the Google Shopping EU General Court judgment (T-612/17) on the decision-making practice of the Commission and the National Competition Authorities (NCAs) of the Member States. Some characteristics of the judgment can be compared with the underway Commission investigations (Amazon Marketplace, Amazon BuyBox, Facebook Marketplace and Google Ad-tech), as well as with the practice of the NCAs (among all, FBA Amazon decision by Italian AGCM). Considerations in principle about equal treatment and access to essential infrastructure provided by the GC in Google Shopping are going to have an impact on ongoing proceedings. Moreover, the NCAs in the EU (and the one in the UK) also seem to share the Commission's activism: Amazon FBA decision by AGCM refers to some of the key points of the ruling. However, some conceptual vagueness cannot be ignored, such as the notion of super-dominant enterprise and that of "abnormal" conduct of the platform capable of justifying a reversal of the burden of proof.
Il contributo si propone di fornire un'analisi sintetica del possibile impatto della sentenza del Tribunale dell'UE su Google Shopping (T-612/17) sulla prassi decisionale della Commissione e delle autorità nazionali della concorrenza (ANC) degli Stati membri. Alcune caratteristiche della sentenza possono essere confrontate con le indagini in corso della Commissione (Amazon Marketplace, Amazon BuyBox, Facebook Marketplace e Google Ad-tech), nonché con la prassi delle ANC (tra tutte, la decisione FBA Amazon dell'AGCM italiana). Infatti, le considerazioni sulla parità di trattamento e sull'accesso alle infrastrutture essenziali espresse dal Tribunale in Google Shopping paiono destinate a essere riprese nei procedimenti in corso. Inoltre, anche le ANC dell'UE (e quella del Regno Unito) sembrano condividere l'attivismo della Commissione: La decisione di Amazon FBA dell'AGCM incorpora alcuni dei punti chiave della sentenza. Tuttavia, non si può ignorare una certa indeterminatezza di alcune nozioni, quali quella di impresa super-dominante e quella di condotta "anomala" della piattaforma in grado di giustificare un'inversione dell'onere della prova.
