La protezione dell'incapace nell'attività negoziale tra annullamento e limiti alle restituzioni

Starting from two recent rulings of the third section of the Italian Civil Supreme Court, one regarding the reimbursements resulting from the cancellation of the contract due to the incapacity of one of the parties (Cass. no. 2460 of 2020) and the other concerning the degree of incapacity of the author necessary to proceed with the cancellation of a unilateral act (Cass. no. 11272 of 2020), the essay examines the evolutionary lines of the protection of the person unable to act by himself and of his assets from prejudicial acts.

Partendo dall'esame di due recenti pronunce della terza sezione della Cassazione Civile italiana, una in merito ai rimborsi conseguenti all'annullamento del contratto per incapacità di una delle parti (Cass. n. 2460 del 2020) e l'altra riguardante il grado di inabilità dell'autore necessario per procedere all'annullamento di un atto unilaterale (Cass. n. 11272 del 2020), il saggio esamina le linee evolutive della tutela dell'incapace e dei suoi beni dagli atti pregiudizievoli.
