According to article 811 of the Italian civil procedure code, where the mandate of an arbitrator terminates during the arbitration a substitute arbitrator shall be appointed according to the rules applicable to the appointment of the arbitrator being replaced. In general, this rule establishes the continuity of the arbitration procedure in all cases where, regardless of the reason (de iure or de facto), an arbitrator is missing. However, this rule does not specify who can ascertain the conditions for replacement. This comment tries to analyze the main interpretative doubts raised by the application of this rule, including, in particular, the scope, the application to multi-party arbitrations, and the consequences of the replacement on the continuation of the arbitration (especially with reference to the problem of repetition of the activity carried out before replacement)
