After the decriminalization of the suicide, it becomes necessary to adapt the new legal reality to other fields; as far as the commercial law is concerned, the debate on the voluntary nature of the suicide, provided for by the Commercial code, engages civil and criminal doctrine and jurisprudence during the end of the XIXth and the first half of the XXth century; this debate brings to different solutions related to the issues of criminal responsibility and passions and it is going to be defined thanks to insurance practices.

Abstract
