The objective of this article is to provide some elements for reflection on the numerous and complex problems related to the return in the past years of the phenomenon of piracy in the Gulf of Aden and in several other sea areas of the world. In particular, the author focuses on problems connected to the inadequacy of the powers recognized to States by international law to combat acts of violence at sea, and on problems connected to countermeasures adopted by shipowners to defend themselves from pirate attacks, and on problems connected to the impact of piracy on maritime transport and charter-party contracts and, finally, on insurance problems.
