This essay aims to criticize the proposed regulation of living will, in particular concerning the lack of a careful consideration for the Oviedo Convention and the foreign experience and, not least, for the existing rules on the designation of a future “amministratore di sostegno”, which allows the person to choose his future guardian, without forbidding instructions concerning the intention to refuse specific medical treatments.
