This is the only Italian book on the drafting of trust instruments in Italian. Drawing on earlier publication of the same author (“L’atto istitutivo di trust, 2005), it proposes a standard subdivision of the contents of trust instruments and then sets out the clauses that should be in each of them. Each clause is accompanied by a discussion of its legal implications and often variants are proposed in order to show how small textual variations may yield important consequences. The same technique is applied to the “contratto di affidamento fiduciario”, a novel contractual structure that aims at attaining results similar to those brought about by trust, but in the context of Italian law.
