The paper is focused on a law of Justinian, Nov. 90 a. 539, on the use of testimonia in trials and on their validity. The content is compared with the rules in the Codex and in the Digesta that relate to the ability to testify. The imperial law is still based on the classical jurisprudence and even in the age of Justinian the testimonia are evalueted as in the classical Roman law.
