In this article the author examines the constitutional and legislative regulation of immigrants' health protection in Italy. She outlines how starting from the Italian Kingdom the health of immigrants has always been protected, untill it became a constitutional right after the born of the Italian Republic and the 1948 Constitution. Also after 1990, following the growth of the number of immigrants coming to Italy, the Immigration Law 1998 continues to guarantee the health of regular and irregular immigrants. The author discuss why this must be considered the better solution for everybody.
