The essay explores the interplay between rules of the Code of Cultural Heritage Goods and Copyright law regarding the ommerce of modern art, in particular concerning “droit de suite”. This recently introduced institute gives to the artist the right to obtain, after the first sale, from a second seller of his works, who is a commercial, a percentage on the increasing of value of the work sold; the buyer pays this percentage over the price. This institute is double faced: on one hand it promotes and protects the artists; on the other hand it increases the cost of work sold in Europe and therefore it influences the future of the art market, pushing it toward areas where this additional cost is not applicable.
