This essay results from an extensive analisy which critically explores the origin and meaning of art. 49, 3, of the Constitution of the Fifth Republic, that has been defined by Pierre Avril the "cornerstone" of French rationalized parliamentarism. The research also examines the changing legal and political conditions for the concrete utilization, in different historical periods, of this powerful instrument, which has been one of the objects of the recent constitutional reform in France. Finally, the study analises, in a comparative perspective, the process of dissemination of the model of implicit approval of statute laws, in Europe and Africa.
