Discussions are taking place, in the context of the so-called "Barcelona international legal system" relating to the protection of the marine environment in the Mediterranean area, regarding the possible adoption of a protocol - or other instrument - concerning civil liability and compensation. The article, which draws from the author's involvement in part of the preparatory works relating thereto, provides an up-to-date critical analysis of the most important challenges implied in such an endeavour.
