Prevenzione della crisi in Francia e in Italia: gli istituti dell'allerta a confronto

Already with the reform that began in 2005, much of the provisions that helped to accentuate the distressing connotation of bankruptcy had given way to crisis-resolution tools that aimed to preserve the residual value of the company and to protect the various subjective positions involved, replacing the technique of elimination from the market with that of the preservation of "healthy" production factors if not even that of recovery. But in the further review that led to the development of the CCI, other useful tools, such as that of the Alert, were prepared, which draws inspiration from its namesake French. On the characteristics of this instrument and the main differences between the french alert and that build by the italian legislature intends to dwell on this study.
